Terms & Conditions

This document sets out the rules for this Promotion. Make sure you read them carefully and understand them all before you enter the Promotion.

1. Introduction
1.1. Octa is giving you the chance to receive a gift. By entering, you agree to be bound by these Terms and Conditions.
1.2. The Promotion name is Octa Trade and Win, hereinafter referred to as the Promotion.
1.3. The Promotion is organised and run by Octa Markets Incorporated, hereinafter referred to as the Promoter.
1.4. ‘The Promoter’, ‘we’, ‘us’ and ‘ours’ refer to Octa, which is a trading name of Octa Markets Incorporated.

2. Who may enter
2.1. The Promotion is open to Octa clients in Malaysia, Indonesia, India, and Singapore aged 18 or over at the time of entry.
2.2. Since July 2023, the Promotion is temporarily available for a limited number of Octa clients in Nigeria. Note that it may be terminated without prior notice from Octa.
2.3. You are not eligible for the Promotion if you are materially connected to the administration of the Promotion.

3. How to enter
3.1.The Clients can join Trade and Win at any time by opening a real account with Octa.
3.2. The Clients can claim gifts depending on their 'prize lots' balance.
3.3. To enter the Promotion, the Clients must trade on their real accounts using any trading instrument we provide.
3.4. Orders on demo accounts do not qualify the Clients to enter the Promotion.
3.5. Order duration is not limited unless it is stated in the Customer Agreement.
3.6. Only closed trades participate in trading volume counts.
3.7. The Clients must close at least one trading order every 30 days to be able to use their prize lots. Otherwise, their prize lots will be temporarily locked. To unlock them, the Client needs to resume trading and close at least one order.

4. The gifts
4.1. The gifts in this Promotion (hereinafter—‘Gifts’) depend on your region. The up-to-date list of the Gifts can be found in your profile.
4.2. The Gifts can be received in exchange for prize lots.
4.3. Prize lots are calculated as follows:
4.3.1. 1 traded lot = 1 prize lot
4.3.2. Octa Status Program participants receive more prize lots for trading: Silver status: 1 traded lot = 1.1 prize lots Gold status: 1 traded lot = 1.25 prize lots Platinum status: 1 traded lot = 1.5 prize lots
4.4. For the Clients who participate in the Octa Status Program, the list of the Gifts may be extended depending on their region and active status in this program. The up-to-date list of the Gifts can be found in your profile.
4.5. The Gifts can be claimed provided that the client has enough prize lots to redeem.
4.6. The prize lots are temporarily locked after 30 days of trading inactivity. To be able to use them again, the Client needs to close at least one trading order.
4.7. The Gifts are limited to one of each type of Gift per month for one person.
4.8. The Gifts and participation in the Promotion cannot be exchanged or transferred. However, in the event that the Gifts offered are unavailable due to circumstances beyond our control, we reserve the right to provide alternative Gifts of equal or greater value or return prize lots spent on the Gifts.
4.9. Gift vouchers or gift certificates (included in the list of Gifts) can only be exchanged for commodities following the terms of the issuer of this voucher or certificate. It is not possible to return gift vouchers or gift certificates received as parts of the Promotion.
4.10. Gift vouchers or gift certificates are only valid in the country chosen by the Client at the time of ordering (country of the Promotion) unless otherwise specified in the Gift description.
4.11. Images used in marketing materials are not necessarily representative of actual Gifts. The actual Gifts may vary.
4.12. Octa does not provide invoices for the Gifts.
4.13. In case of failure of the electronic Gift unrelated to violation of the maintenance conditions set forth in the Gift’s service manual or on the producer’s site:
4.13.1. For Octa-branded electronic Gift, Octa undertakes to replace such Gift if you report the matter to Octa’s Customer Support within 105 days from the date it was shipped to you (the delivery time included)
4.13.2. For non-Octa-branded electronic Gift (any electronic Gift without ‘Octa’ on it), Octa undertakes to replace such Gift if you report the matter to Octa’s Customer Support within 45 days from the date it was shipped to you (the delivery time included)
4.13.3. For non-Octa-branded electronic Gift (any electronic Gift without ‘Octa’ on it) in other cases, contact the Gift manufacturer service centre in your area.
4.14. In case the Gift was damaged during the shipment, the Promoter undertakes to replace such Gift if you reported the damage and sent a photo proof or video proof to Octa’s Customer Support within 7 days from the delivery date.
4.15. If the non-electronic Gift is delivered defected or become faulty, not related to violation of the maintenance conditions, and you report the issue to our Customer Support within six months of claiming such Gift on the Promotion page, the Promoter undertakes to replace such Gift or cancel the order and return prize lots spent on the Gift.
4.16. In the product descriptions for clothing items, body measurements corresponding to each available size are provided. When placing an order for such a Gift, customers acknowledge and confirm that they have reviewed these body measurements and selected a suitable size. Once an order is created, changing the size is not possible, including after the receipt and trying on the Gift. By creating an order within the Trade and Win gift collection, a customer confirms they have read the body measurements and chosen a suitable size. The Promoter reserves the right to resolve uncertain sizing disputes on a case-by-case basis.
4.17. The Promoter is not liable for loss, corruption, damage, or any security issues arising from or in connection with using the Gifts.
4.18. The Promoter can amend the amount of prize lots required to claim the Gift at their sole discretion at any time. The change takes effect from the moment it is posted on the Promotion page.
4.19. Upon ordering electronics through the Promotion, the customer agrees to the potential pre-installation of applications and files on the device, including but not limited to personalised features such as wallpapers, lock screen images, and animations for device startup and shutdown, which are associated with Octa. These customisations are made to enhance user experience and do not provide for any personal data collection or storage. By creating an order within the Trade and Win gift collection, a customer confirms they have read and accepted these conditions.

5. Delivery
5.1. Your Gift will be delivered to your chosen address within ten weeks of claiming your Gift.
5.2. Only the client who claimed the Gift can be the recipient.
5.3. The delivery address must be in the country of the Promotion.
5.4. Clients cannot change their delivery address and contact information once the Gift has been claimed. The Promoter does not guarantee Gift delivery if a client provides an incorrect delivery address and contact details.
5.5. If a client does not respond to phone calls from the delivery service, the Promoter will ask the client to update the delivery address and contact information. If they are not updated within the following week or remain incorrect after the update, the Promoter has the right to cancel the order and return prize lots spent on the Gift.
5.6. The Gift is personally handed to the client by a courier.
5.6.1. If the client lives on a closed territory, such as a condominium, and the courier can’t hand the Gift personally, the courier will leave the Gift with the guard and inform the client. The courier will bear no further responsibility for the Gift.
5.7. The courier has the right not to hand the Gift if the client refuses to
5.7.1. Sign the delivery document, or provide the OTP (one-time password) or other proofs required by the delivery company
5.7.2. Take a picture with the Gift for the Promoter’s record.
5.7.3. In such cases, the Promoter retrieves the Gift, and the prize lots are restored in the client’s Personal Area.
5.8. Our Customer Support handles complaints and appeals regarding the delivery of the Gift provided by the companies Delhivery, Tiki, and Ninjavan only within seven days after the Gift is delivered to the client. All later complaints and appeals should be addressed to the mentioned companies directly.

6. General
6.1. Any kind of IP match will be subject to disqualification.
6.2. Any kind of arbitrage trading or any other abuse with pricing and/or quotes will be subject to disqualification from the Promotion.
6.3. The Promoter reserves the right to disqualify the customer from the Promotion in case of detecting any resale of the acquired Gifts to third parties.
6.4. The Promoter reserves the right to reject or disqualify any participant without explaining the reason. Reasons for disqualification may include opening big volume opposite orders with the same currency pairs in different trading accounts at approximately the same time, the usage of failures in the quote flow for guaranteed profit, or any other kinds of cheating.
6.5. All trading techniques or EAs are allowed. The Promoter reserves the right to declare any Gift already given invalid and subject to cancellation upon direct or indirect evidence of attempted fraudulent operations with the prize funds.
6.6. Each participant agrees to provide authentic delivery information. Providing incorrect information may result in disqualification from the Promotion.
6.7. By participating in this Promotion, you automatically grant permission to the Promoter to use your full name and country of residence in future Promoter’s marketing activities and on the company website.
6.8. Any situation not described in these Terms and Conditions shall be subject to the Promoter's decision.
6.9. The Promoter reserves the right to amend and/or update these Terms and Conditions at anytime without prior notification.
6.10. The Promoter is Octa, First floor, Meridian Place, Choc Estate, Castries, Saint Lucia.

7. Octa content policy
7.1 You may post comments, reviews, photos, videos, and other content; and submit suggestions, questions, ideas, or other information, as long as the content is not illegal, threatening, defamatory, obscene, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable, and does not consist of or contain software viruses, chain letters, commercial solicitation, mass mailings, or any form of ‘’spam” or unsolicited commercial electronic messages.
7.2 If you do post content or submit material, and unless indicate otherwise, you grant Octa a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute, and display such content throughout the world in any Octa media.
7.3 You grant Octa and sublicense the right to use the name that you submit in connection with such content, if they choose.
7.4 You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify Octa for all claims resulting from content you supply.
7.5 Octa has the right but not the obligation to monitor and edit or remove any activity or content.
7.6 Octa takes no responsibility and assumes no liability for any content posted by you or any third party.
7.7 In case of violation of any warranties and/or representations provided in the policy, you undertake to compensate Octa for all damages related to third party claims against Octa in connection with the use of the content.
